Terms of service
Core rules for business use of wayfold.
Last updated: 11 October 2026
Scope
These terms govern business use of wayfold. The provider is minddraft AG, Säntisstrasse 12 6345 Neuheim Schweiz. Anyone acting for a business must be authorised to represent it. Individually agreed contractual provisions take precedence; the expressly incorporated data processing agreement takes precedence for processing on behalf of customers. A paid subscription is concluded through the order confirmed at checkout and its acceptance. Orders labelled “Sold through Link” are additionally subject to the Link purchase terms displayed at checkout. We remain responsible for providing wayfold and its functionality. The privacy notice explains processing; it is not blanket consent to additional purposes.
Accounts and workspaces
Users must provide accurate information and protect access. Every workspace has an owner who manages team access, properties, and billing. Actions by invited members are attributed to the workspace. Test Mode is deliberately started by a logged-in, authorized team member. Pins and comments are shared in the workspace with attribution. The team is responsible for submitted content and must not include prohibited personal data or credentials. This feature is separate from visitor analytics.
Service
wayfold provides privacy-first analytics, journeys, heatmaps, funnels, reports, and related functions under the selected plan. Preview, beta, and experimental features may change or be discontinued.
Acceptable use
The service must not be used unlawfully, abusively, for re-identification, surveillance, or collection of sensitive content. Automated overload, limit circumvention, attacks, and resale without agreement are prohibited.
Plans and billing
The selected plan, billing interval, capacity and total price including applicable taxes shown before purchase govern the order. Billing is in advance for the selected monthly or annual period. The subscription renews for the same interval unless cancelled before renewal. Additional capacity is selected expressly; there are no automatic usage-based overage invoices. An offered trial does not become chargeable merely because time passes. A paid subscription requires an order. Exhausted capacity or unpaid amounts due may result in the collection and access restrictions explained in the product. Plan changes apply according to the confirmed change summary. We notify customers of price changes at least 30 days before they apply to a new contractual period; cancellation before that period remains possible.
Customer responsibilities
The customer is responsible for its properties, tracking configuration, legal notices, required consent, event names, and transmitted properties. Direct identifiers or content not agreed for processing with wayfold must not be transmitted.
Operation and changes
We operate wayfold with reasonable care and may perform maintenance, security measures, and necessary changes. Continuous availability is guaranteed only under a separate SLA.
Warranty and liability
Analytics and recommendations support decisions; they do not guarantee business outcomes or the completeness of every measurement. Please report apparent defects to support@wayfold.ch so we can investigate and remedy them. For ordinary negligence, and to the extent permitted by law, our liability is limited to foreseeable direct loss and, in total, to the fees paid for the affected service in the twelve months preceding the event. This limitation does not apply to intent, gross negligence, personal injury or other liability that cannot lawfully be excluded. Mandatory rights of affected individuals remain unaffected.
Term and termination
The workspace owner may cancel the subscription through the billing portal at the end of the current billing period. Contact support@wayfold.ch if access fails. Cancellation prevents further renewals; it does not automatically delete the user account or all workspace data. Refunds follow the agreed order terms and, for Link orders, its refund rules; mandatory rights remain unaffected. For material contractual breaches, we may terminate or restrict access after a reasonable opportunity to remedy the breach. An immediate restriction is permitted where necessary for an imminent security risk or binding legal requirement. Customers should export needed data before the contract ends. Requests for return and deletion can be sent to support@wayfold.ch; entrusted data is governed by the data processing agreement. Legally required business records are retained separately.
Law and venue
Swiss law applies, excluding conflict-of-law rules. To the extent legally permitted, the registered office of minddraft AG is the exclusive venue. Mandatory venues remain unaffected.
